Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Dresson.ai website (the "Service") operated by The Dresson.ai Team ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Accounts and Registration
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Subscriptions and Payments
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").
Payment Processors: We use third-party payment processors (e.g., PayPal) to handle financial transactions. By making a payment, you agree to the terms and conditions of these third-party providers. We do not store your full credit card information.
Refunds: Except when required by law, paid Subscription fees are non-refundable. Certain refund requests for Subscriptions may be considered by The Dresson.ai Team on a case-by-case basis and granted at the sole discretion of The Dresson.ai Team.
3. AI-Generated Content and Usage
Service Nature: Dresson.ai utilizes Artificial Intelligence (AI) technologies to generate images and content. You acknowledge that AI generations are probabilistic and may produce inaccurate, offensive, or unexpected results.
Ownership: Subject to your compliance with these Terms, you own the rights to the input you provide and the images generated by the Service for your account ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to use, copy, and display such User Content solely for the purpose of providing and improving the Service.
No Guarantees: We do not guarantee that the AI-generated content will meet your specific requirements or be suitable for any particular purpose.
4. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of The Dresson.ai Team and its licensors. The Service is protected by copyright, trademark, and other laws of both the People's Republic of China and foreign countries.
5. Prohibited Uses
You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation.
- To generate content that is sexually explicit, hateful, harassing, or illegal.
- To attempt to reverse engineer, decompile, or disassemble any part of the Service.
- To infringe upon the rights of others, including privacy and intellectual property rights.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
7. Limitation of Liability
IN NO EVENT SHALL THE DRESSON.AI TEAM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
8. Disclaimer
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR COURSE OF PERFORMANCE.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the People's Republic of China (PRC), without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be settled by the competent court in Shanghai, China.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
11. Miscellaneous
Entire Agreement
These Terms constitute the entire agreement between you and The Dresson.ai Team regarding your use of the Service and supersede any prior agreements between you and The Dresson.ai Team.
Waiver and Severability
No waiver by The Dresson.ai Team of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of The Dresson.ai Team to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
Assignment
The Dresson.ai Team may assign, transfer, and subcontract its rights and/or obligations under these Terms without your consent. However, you may not assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
No Agency
No agency, partnership, joint venture, or employment relationship exists between you and The Dresson.ai Team as a result of these Terms or use of the Service.
